1. Scope

This Privacy Policy (“Privacy Policy”) is designed to help you understand how Collectors DataStore, LLC (“CDS,” “we,” “our,” or “us”) collects, uses, shares, and otherwise processes personal information, and how you can exercise your privacy rights.

CDS is a wholly owned subsidiary of Ludex LLC and operates as its data licensing and commercialization arm. CDS licenses personal information collected by Ludex through its apps and websites (such as Ludex.com and the Ludex mobile app) and makes that data available to enterprise partners and data customers.

This Privacy Policy applies to information we license and disclose through our data offerings and data products (collectively, the “Services”). This Privacy Policy does not apply to information collected in the job applicant or worker context.

If you reside in a U.S. state with a consumer privacy law (e.g., California, Colorado, Virginia, Connecticut, Utah, Texas), please refer to the U.S. State Supplemental Privacy Notice below.

2. Personal Information We Collect

Because CDS operates as a data broker, we do not collect information directly from individuals. Instead, we license and process information provided to us by Ludex and other lawful sources. The categories of personal information we license may include:

  • Identifiers: Name, alias, postal address, email address, IP address, or other unique identifiers.
  • Customer Records Information: As defined in Cal. Civ. Code § 1798.80(e), including contact information and account records.
  • Commercial Information: Card collection data, marketplace activities, transaction data (e.g., sales activity, purchase history), and collectible behaviors.
  • Internet/Network Activity: Data on interactions with Ludex apps, websites, and embedded technologies (including cookies such as YouTube video embeds).
  • Geolocation Data: Approximate location derived from IP addresses.
  • Inferences: Profiles reflecting preferences, interests, or behaviors in the collectibles space.

We may also supplement this data with information obtained from public or third-party sources. For example, we may receive additional demographic, behavioral, or interest-based information from third-party data aggregator partners to supplement the information we collect about you. This information helps us improve our data products, analytics, and services.

3. How We Use Personal Information

We use and license information to:

  • To develop, maintain, and provide data products and Services, including to operate, troubleshoot, develop, improve, upgrade or enhance our existing data products and Services or those we are considering offering in the future.
  • To license and commercialize our data products, we provide personal information to our customers and data-aggregator/enrichment partners (and, where applicable, to affiliates such as Ludex LLC) for identity resolution, analytics, measurement, and marketing uses, including limited onward disclosure by those partners to their customers for the same purposes, as permitted by law and our contracts.
  • To provide access to and maintain our Services, including to provide access to certain areas, functionalities, and features of our Services to our licensees.
  • Enable our licensees (e.g., marketing platforms, analytics providers, and sports/entertainment partners) to better understand audience trends and behaviors.
  • Support research, analytics, and joint commercial initiatives with our partners.
  • Comply with applicable laws and regulations.
  • To respond to or notify you, including when you contact us with a comment, request, or question; request information about our data products or Services; or to send you technical notices, updates, security alerts, and other administrative messages.
  • For our business purposes, including to operate and improve our business, data products, and Services, in connection with potential business transactions (e.g., mergers or acquisitions), internal administration, debugging to identify and repair our Services-related errors, quality control, and data analysis; and for any other business purpose permitted by law.
  • For legal compliance and safety purposes, such as to enforce our agreements and policies and notify you of changes; carry out activities that are required to comply with our legal obligations imposed by law, regulation, decree, court order, or legal settlement); investigate illegal activities, suspected fraud, or potential threats to the safety of any person; provide evidence in litigation in which we or our clients are involved; and other legitimate business purposes as permitted by law.
  • Protect our rights, our affiliates, and the rights of others.
  • For purposes that you have otherwise consented to
  • For other purposes permitted by applicable law, including to create de-identified, aggregated, or anonymized information.

4. How We Disclose Personal Information

We disclose information to third parties for various business purposes, including:

  • Data Partners and Data Product Licensees: We share your information with our data aggregator partners that jointly develop our data products as well as enterprise customers that license Ludex-collected data from CDS.
  • Affiliates: We share your information with our affiliates including Ludex LLC, which provides CDS with the underlying data. Service Providers: We share your information with third-party service provieers and vendors that support CDS operations. This includes providers offering IT support, cloud hosting, analytics, security, and related services.
  • Professional Advisors: We share your information with our professional advisors, such as lawyers, auditors, and insurers, when necessary. Our professional advisors use your information only as directed or authorized by us and are prohibited from using or disclosing your information for any other purpose.
  • Legal and Regulatory Authorities: We share your information where required by law, subpoena, or court order.
  • Business Transactions: We share your information in connection with mergers, acquisitions, financing, or sale of assets.

5. Sale and Sharing of Personal Information

As defined by U.S. state privacy laws (including the California Privacy Rights Act, or CPRA), CDS is engaged in the sale and sharing of personal information.

  1. Data Licensing and Commercialization: CDS licenses datasets containing personal information to enterprise customers and to its third-party data aggregator partners, who jointly develop and enhance CDS’s data products. This exchange of personal information for monetary or other valuable consideration qualifies as a “sale” under applicable law. These activities also may constitute “sharing” for cross-context behavioral advertising purposes under state privacy laws.
  2. Limitations: CDS does not knowingly sell or share personal information of individuals under the age of 16. Because Ludex prohibits users under 16 from using its consumer-facing Services, CDS’s licensed data products are not intended to include the personal information of children or teens under 16. You may opt out of CDS’s sale and sharing activities as described in Section 6 “Your Rights and Choices” section of this Privacy Policy. We do not knowingly sell or share personal information of individuals under 16. Because our affiliate Ludex does not permit users under 16 to access its consumer-facing platforms, CDS does not receive or license such data for its data products.

6. Your Privacy Rights

Depending on your state of residence, you may have certain privacy rights related to certain types of the personal information we collect and process, as detailed further below:

  • Request to Know: You may have the right to request confirmation of whether we are processing or have processed your personal information. Additionally, you may be able to request disclosure of the personal information we have collected about you, including:
    • The categories of personal information we have collected
    • The categories of sources from which such personal information is collected
    • The business or commercial purposes for collecting, selling, or sharing your personal information
    • The categories or specific third parties to whom we disclose or have disclosed your personal information
    • The specific pieces of your personal information that we maintain or have processed
  • Request to Delete: You may have a right to request that we delete the personal information that we may maintain about you.
  • Request to Correct Inaccurate Personal Information: You may have the right to request that we correct our copy of your personal information where it is inaccurate or incomplete.
  • Request to Opt-Out of Sale, Sharing, and Certain Profiling Activities: As explained in this Privacy Policy, you may have the right to opt out of certain activities involving your personal information. Specifically, you can opt out of our “sale” of your personal information to third parties, the sharing of your personal information for targeted or cross-context behavioral advertising, and certain profiling activities that result in legal or similarly significant effects on you.
  • Right to No Discrimination: You have a right not to receive discriminatory treatment for the exercise of your privacy rights.

We will provide information in response to your verified privacy requests free of charge up to two (2) times in any twelve (12) month period. For additional requests beyond this limit, or or requests that are manifestly unfounded, repetitive, or excessive, we may charge a reasonable fee to cover the administrative costs of responding to your request, or we may refuse to act on the request and notify you of the reason for refusal.

How We Process Requests: We will process your requests in accordance with applicable laws and subject to the following:

  • Verification Methods: Once you submit a request, we will verify that you are the consumer to which the request pertains by matching the identifying information provided by you (e.g. name, email address, phone number) to the information we maintain. If we are unable to verify your request with the data points you provided, we may reach out to you for additional information to verify your request. Please note that opt-out requests do not require verification.
  • Authorized Agent: Your “authorized agent” can submit a request on your behalf using the same methods described above. We may ask the authorized agent to provide a signed authorization from you, confirming their authority to act on your behalf. Additionally, we might require you to verify your own identity directly with us.

7. Security of Your Information

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.

8. Data Retention

We store personal information we collect as described in this Privacy Policy as long as necessary to fulfill contractual obligations, maintain data product integrity, comply with legal obligations, conduct audits, resolve disputes, enforce our agreements, and support legitimate business purposes.

9. Children’s Information

CDS does not knowingly license or commercialize personal information of individuals under the age of 16. Our Services and data products are not directed to anyone under 16, and we prohibit their use. If you are a parent or guardian and believe that a child under 16 has provided personal information to CDS, please contact us. If we become aware that we have collected such information, we will take steps to delete it.

10. Third-Party Websites/Applications

The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage you to read the privacy policies of each website and application you may interact with. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. You agree that if you elect to provide personal information to third-party websites or applications encountered through our Services, you do so at your own risk.

11. Changes to This Notice

We may revise this Privacy Policy from time to time in our sole discretion. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy policy if you continue to use our Services after the new Privacy Policy takes effect.

U.S. State Supplemental Privacy Notice

This U.S. State Supplemental Privacy Notice (“Supplemental Notice”) supplements our main Privacy Policy (collectively, our “Privacy Statements”) and applies to residents of U.S. states with comprehensive privacy legislation, such as the California Consumer Privacy Act of 2018, the Oregon Consumer Privacy Act, the Texas Data Privacy and Security Act, and other similar laws that may be enacted (each, a “State Privacy Law”). 9. Data Broker Registration

Texas Data Broker Disclosure: Collectors Data Store, LLC is a registered data broker under Texas law. To conduct business in Texas, data brokers must register with the Texas Secretary of State (SOS). Information about registered data brokers is available on the Texas SOS website at https://www.sos.state.tx.us.

10. Changes

We may update our Privacy Statements periodically, noting the date of revision at the top. If we make any material changes in the way we collect, use, and/or disclose personal information, we will endeavor to provide you with notice before such changes take effect, such as by posting a prominent notice on the Services.
